If a Man Says to His Wife, 'When You Menstruate, You Are Divorced,' What Is the Ruling?

Hadith 20212
٢٠٢١٢ - حدثنا أبو بكر قال: نا يحيى بن آدم قال: نا زهير عن جابر عن عامر (و) (١) الحكم في امرأة قال لها زوجها: إذا حضت فأنت طالق، فارتفعت حيضتها و (حبلت) (٢) (قالا) (٣): (٤) (يجامعها) (٥) حتى تحيض.
Hazrat Amir (may Allah have mercy on him) and Hazrat Hakam (may Allah have mercy on him) say that if a man says to his wife, "When you menstruate, you are divorced," then her menstruation stops and she becomes pregnant, the man can have intercourse with her until she menstruates. Hazrat Amir (may Allah have mercy on him) says that if this is valid in the near term, it is also valid in the distant term.
Hadith 20213
٢٠٢١٣ - وقال عامر: إن صلح في القريب (فإنه) (١) يصلح في البعيد.
20213 - And ‘Amir said: If reconciliation is possible with the near one, then it is possible with the distant one.
