Hadith 20102
٢٠١٠٢ - حدثنا أبو بكر قال: نا إسماعيل ابن علية عن يونس (أن) (١) ابن سيرين (٢) كان يرى لكل حامل نفقة قال: (فولي) (٣) أم ولد يعلى بن خالد فكان يرى لها النفقة، فكره أن ينفق (عليها) (٤) دون القاضي، فأرسل إلى عبد الملك بن يعلى فمنعها (٥).
Hazrat Ibn Sirin (may Allah have mercy on him) was of the opinion that every pregnant woman is entitled to maintenance. He gave the opinion of maintenance for the Umm Walad of Ya'la (may Allah be pleased with him) bin Khalid, but he considered it undesirable that maintenance be given to an Umm Walad without the decision of a judge. When he sent a message to Abdul Malik bin Ya'la (may Allah be pleased with him), he forbade maintenance. Hasan used to say that she will be provided for; if she gives birth to a living child, then her maintenance will be from the child's share, and if she gives birth to a stillborn child, then it will be considered void.
Hadith 20103
٢٠١٠٣ - وقال: كان الحسن يقول: ينفق عليها، فإن ولدته حيا فنفقتها من نصيب ولدها، وإن ولدته ميتًا ألغي ذلك.
20103 - And he said: Al-Hasan used to say: He spends on her, and if she gives birth to him alive, then her maintenance is from the share of her child, and if she gives birth to him dead, that is cancelled.
Hadith 20104
٢٠١٠٤ - حدثنا أبو بكر قال: نا عبد الوهاب الثقفي عن برد عن مكحول قال: إذا كانت أم ولد فتوفي عنها سيدها؛ فنفقتها من نصيب الذي في بطنها.
Hazrat Mak'hool (may Allah have mercy on him) says that if the master of an umm walad passes away, then her maintenance will be from the share of what she carries in her womb.
