Those Scholars Who Say a Woman with a Specified Dowry Is Not Entitled to Muta’
Hadith 19773
١٩٧٧٣ - حدثنا أبو بكر قال: نا وكيع عن ابن أبي ليلى عن نافع عن ابن عمر قال: (١) لكل مطلقة متاع إلا (التي) (٢) طلقت (وقد) (٣) فرض لها (٤).
Hazrat Ibn Umar (may Allah be pleased with both of them) narrates that every divorced woman will receive Mut‘ah except for the woman for whom a dowry was fixed and she was divorced.
Hadith 19774
١٩٧٧٤ - حدثنا أبو بكر قال: نا إسماعيل (١) (بن علية) (٢) عن ابن (أبي) (٣) نجيح عن عطاء قال: سئل (٤) الرجل يطلق امرأته وقد فرض (لها) (٥) قبل أن يدخل بها، (لها) (٦) متاع؟ قال: كان عطاء يقول: لا متاع لها.
Hazrat Ata (may Allah have mercy on him) was asked: If a person fixes a dowry for his wife and divorces her before consummation, will she receive Mut'ah? He replied: She will not receive Mut'ah.
Hadith 19775
١٩٧٧٥ - حدثنا أبو بكر قال: نا ابن علية عن أيوب عن نافع قال: إذا طلق الرجل المرأة وقد فرض لها فلها نصف الصداق ولا متاع لها.
Hazrat Nafi' (may Allah have mercy on him) says that if a man divorces a woman and had fixed a dowry for her, then she will receive half of the dowry and she will not receive any mut'ah.
Hadith 19776
١٩٧٧٦ - حدثنا أبو بكر قال: نا وكيع عن شعبة (و) (١) المسعودي عن الحكم عن إبراهيم عن شريح قال: إن لها في النصف (لمتاعًا) (٢) يعني التي لم يدخل بها.
Hazrat Shurayh (may Allah have mercy on him) says that for a woman with whom intercourse has not taken place, half of the dowry will be given as compensation.
