Ruling If a Man Makes Ila', the Wife Observes Iddah, and He Then Divorces Her
Hadith 19697
١٩٦٩٧ - حدثنا أبو بكر قال: نا عبد الأعلى عن يونس عن الحسن قال: إذا انقضت عدة الإيلاء (فطلق) (١) فإنه لا يعده شيئًا.
Hasan (may Allah have mercy on him) said that if, after the expiration of the waiting period of Ila, the woman is divorced, then the previous waiting period will not be counted.
Hadith 19698
١٩٦٩٨ - حدثنا أبو بكر قال: نا جرير عن مغيرة عن إبراهيم قال: إذا قال الرجل لامرأته وهي تعتد منه في الإيلاء أو طلاق: هي طالق (١) فإن ذلك جائز عليها، فإذا قال: أنت طالق بعد ما انقضت عدتها فليس بشيء، يطلق ما لا يملك.
Ibrahim (may Allah have mercy on him) said that if a man's wife is observing the waiting period ('iddah) of ila' or divorce, and during the 'iddah the man divorces her again, then the divorce is valid. If he divorces her after the 'iddah has ended, then that divorce has no validity.
