If a Woman Takes Khul, Then Remarries the Same Husband and Is Divorced Before Consummation—How Much Dowry Is Due?
Hadith 19572
١٩٥٧٢ - حدثنا أبو بكر قال: نا (معتمر) (١) عن منصور عن إبراهيم في رجل بانت منه امرأته بخلع أو إيلاء، فتزوجها (فطلقها) (٢) قبل أن يدخل بها قال: لها الصداق كاملًا.
Ibrahim (may Allah have mercy on him) was asked: If a woman separates from her husband through khul‘ or ila’, then the man marries the same woman and divorces her before consummation, what is the ruling? He replied: The woman will receive the full mahr.
Hadith 19573
١٩٥٧٣ - حدثنا أبو بكر قال: نا يحيى بن زكريا بن أبي زائدة عن إسماعيل (وأشعث عن) (١) الشعبي في الرجل يطلق امرأته تطليقة (بائنة) (٢) ثم يتزوجها في عدتها- ثم يطلقها قبل أن يدخل بها قال: (لها) (٣) الصداق، وعليها عدة (مستقبلة) (٤).
Hazrat Sha'bi (may Allah have mercy on him) was asked: If a man gives his wife an irrevocable divorce, then the man marries the same woman during her waiting period, and before consummation he divorces her, what is the ruling? He replied: The woman will receive the full dowry and the full waiting period will be obligatory upon her.
Hadith 19574
١٩٥٧٤ - حدثنا أبو بكر قال: نا بن أبي زائدة عن سفيان عن منصور عن إبراهيم مثله، ((و) (١) قال هو) (٢) أملك (برجعتها) (٣).
It is similarly narrated from Ibrahim (may Allah have mercy on him), and he says that he has more right to take her back.
Hadith 19575
١٩٥٧٥ - حدثنا أبو بكر قال: نا وكيع عن شعبة عن الحكم عن إبراهيم (قال) (١): لها الصداق كاملًا وعليها العدة كاملًا.
Ibrahim (may Allah have mercy on him) said that she will receive the full dowry and the woman will be required to observe the complete waiting period.
