Those Scholars Who Say If a Non-Muslim Woman Accepts Islam and Her Husband Refuses, It Is Like One Divorce
Hadith 19325
١٩٣٢٥ - حدثنا أبو بكر قال: نا معتمر بن سليمان عن أبيه أن الحسن وعمر بن عبد العزيز قالا: تطليقة بائنة.
Hasan and Hazrat Umar bin Abdul Aziz (may Allah have mercy on him) say that this is a single irrevocable divorce.
Hadith 19326
١٩٣٢٦ - حدثنا أبو بكر قال: نا عبدة بن سليمان عن (١) (سعيد) (٢) عن قتادة عن الحسن قال: إذا كان الرجل وامرأته مشركين فأسلمت وأبى أن يسلم، بانت منه بواحدة.
Hasan (may Allah have mercy on him) says that when a man and his wife are both polytheists and the wife accepts Islam but the husband refuses to accept Islam, then the woman will receive one irrevocable divorce, and Hazrat Ikrimah (may Allah have mercy on him) also used to say the same.
Hadith 19328
١٩٣٢٨ - حدثنا أبو بكر (قال: نا) (١) معن (بن) (٢) عيسى عن ابن أبي ذئب عن الزهري قال: تفريق الإمام تطليقة.
Hazrat Zuhri (may Allah have mercy on him) says that the separation carried out by a judge is considered one divorce.
