Musannaf Ibn Abi Shaybah

Ibrahim (may Allah have mercy on him) was asked: If a man gives his wife three divorces and then denies it, what is the ruling? He replied: This case should be taken to the Sultan, and the man should be made to swear an oath. If he swears, then in my opinion it is better that the woman gives him compensation and obtains khul‘ (divorce through compensation).

Ibrahim (may Allah have mercy on him) said that if a man gives his wife three divorces and then denies it, then if the woman is truthful, it is permissible for her to obtain khul‘ (divorce) by giving compensation.

Hasan (may Allah have mercy on him) says that in such a situation, the woman should take her husband to the ruler, and he should make him swear an oath.

It was asked from Hasan (may Allah have mercy on him) that a woman claims her husband has given her three divorces, but she has no witnesses. What should she do? He replied that she should remain with him and not leave him.

Hazrat Jabir bin Zaid (may Allah have mercy on him) says that as long as they remain together, they will commit adultery.

Hazrat Mujahid (may Allah have mercy on him) narrates that the husband of a slave woman belonging to Hazrat Ibn Umar (may Allah be pleased with them both) used to divorce her in seclusion. When the slave woman spoke to Hazrat Ibn Umar (may Allah be pleased with them both), he made her husband swear an oath and then separated them.

A venerable elder, Abu Amr (may Allah have mercy on him), relates: I was sitting with Hazrat Abdullah bin Abbas (may Allah be pleased with them both) when a woman came and said, "My husband divorces me in private, but when in front of people, he denies it." He (Ibn Abbas) said: "The man should swear four times by Allah that he has not divorced her, and the fifth time he should say: 'If I have divorced her, then may Allah's curse be upon me.'"

Hazrat Ibn Sirin (may Allah have mercy on him) says that if a man denies having divorced his wife after giving her divorce, then the woman should leave him.

Hazrat Zuhri (may Allah have mercy on him) says that if a person denies after giving divorce, then the woman should make him swear an oath after prayer; if he swears the oath, then the woman will return.

Hazrat Shu’bah (may Allah have mercy on him) says that I asked Hazrat Hammad (may Allah have mercy on him): If a person gives his wife three divorces and the woman has no witnesses, and the man denies it, then what is the ruling? He replied that the woman should give compensation and free herself from that man. I asked, if the man denies (the divorce), then what? He replied that the woman should run away from him, she should not stay with him.

Muhammad, may Allah have mercy on him, used to advise the woman to run away from the man in such a situation.
