Musannaf Ibn Abi Shaybah

Hazrat Abdullah (may Allah have mercy on him) says that if a person gifts his wife to her own family, then if her family accepts, it is one divorce and he will have the right to take her back, and if they do not accept, then nothing is binding.

Ibrahim (may Allah have mercy on him) said that if a man gifts his wife to her own family, then if they accept, it is one divorce and he will have the right to take her back.

Hazrat Abdullah (may Allah be pleased with him) says that if a person says to his wife, "Decide your own matter," or says, "You have the choice," or says, "I have gifted you to your family," then these are words of one divorce.

Hasan (may Allah have mercy on him) narrates from a Companion that if a man gifts his wife to her own family, then if they accept, it is one irrevocable divorce (talaq bainah), and if they do not accept, it is one divorce and the man will have the right to take her back.

Hazrat Zaid bin Thabit (may Allah have mercy on him) says that if a person gifts his wife to her own family, it is equivalent to three divorces; now that woman is not lawful for that husband until she marries another man. If they refuse to accept, then it is one divorce and the man has the right to take her back. This was also the opinion of Hasan (may Allah have mercy on him).

Hazrat Ata (may Allah have mercy on him) says that if a person gifts his wife to her own family, then if they accept, one divorce takes place, and if they do not accept, nothing is necessary.

Hazrat Tawus (may Allah have mercy on him) says that if a person gifts his wife to her own family, it counts as one divorce and the man will have the right to take her back.

Hazrat Ali (may Allah be pleased with him) says that if a person gifts his wife to her own family, then if they accept, it is one irrevocable divorce (talaq bainah), and if they refuse, it is one revocable divorce (talaq raj‘i), and the man will have the right to take her back.

It is narrated similarly through another chain of transmission.

Hazrat Waki’ (may Allah have mercy on him) says that if a person gifts his wife to her own family, then if he did not intend divorce, nothing happens whether they accept it or return it; and if he intended divorce, then whatever he intended will take place whether they return it or accept it.
