Those Scholars Who Say the Woman Retains Authority Until She Speaks
Hadith 19110
١٩١١٠ - حدثنا أبو بكر قال: نا جرير بن عبد الحميد عن منصور عن الحكم عن علي في رجل جعل أمر امرأته بيدها قال: هو لها حتى تتكلم، أو جعل أمر امرأته ⦗١٩٠⦘ بيد رجل قال: هو بيده حتى (يتكلم) (١) (٢).
Hazrat Ali (may Allah be pleased with him) says that if a person gives his wife the right (of divorce), it will remain with her until she speaks (makes a decision). Similarly, if this right is given to another man, it will also remain with that man until he speaks; that is, when he speaks, the right will end.
Hadith 19111
١٩١١١ - حدثنا أبو بكر قال: نا أبو داود الطيالسي عن حماد بن سلمة عن حميد عن الحسن بن مسلم أن رجلًا جعل أمر امرأته بيدها فقامت ولم تقض شيئًا فرفع إلى ابن الزبير (فقال) (١): على ما قمتِ؟ قالت: على أن لا أرجع إليه فأبانها (عنه) (٢) (٣).
Hazrat Hasan bin Muslim (may Allah have mercy on him) narrates that a man entrusted the matter of divorce to his wife. She stood up but did not make any decision. This matter was presented before Hazrat Abdullah bin Zubair (may Allah be pleased with him). He asked the woman, "With what intention did you stand up?" She replied, "I stood up with the intention that I would never return to him again." Hazrat Abdullah bin Zubair (may Allah be pleased with him) separated the woman from the man.
