Musannaf Ibn Abi Shaybah

Ibrahim (may Allah have mercy on him) said that if someone writes a divorce for his wife with his own hand, it will take effect.

Hazrat Ali (may Allah be pleased with him) bin Hakam Banani (may Allah have mercy on him) narrates that a man wrote a divorce for his wife with his own hand on a pillow. Regarding this, Hazrat Shabi (may Allah have mercy on him) was asked, and he declared it a divorce.

Hazrat Ata (may Allah have mercy on him) was asked: If a person wrote a divorce to his wife, then regretted it and withheld the letter, will the divorce take place or not? He replied: If he withheld it, the divorce will not take place, and if he let it go, the divorce will take place.

Hasan (may Allah have mercy on him) says that if a person writes a divorce to his wife, then thinks to withhold the letter, then if he does not speak (about it), it has no significance. If the letter is sent to the wife, then from the day she receives the letter, the woman will count her waiting period (‘iddah) from that day.

Hazrat Hammad (may Allah have mercy on him) says that if a man wrote a letter to his wife and wrote in it that when this letter reaches you, you are divorced, then if the letter does not reach her, the divorce will not take place. And if he wrote in the letter: "Amma ba'd! You are divorced," then even if the letter does not reach her, the divorce will take place.
