Musannaf Ibn Abi Shaybah

It is narrated from Hazrat Abdullah bin Amr (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: Divorce takes place only after marriage.

It is narrated from Hazrat Tawoos (may Allah have mercy on him) that the Messenger of Allah (peace and blessings be upon him) said: Divorce takes place after marriage, and emancipation takes place after ownership.

Hazrat Ali (may Allah be pleased with him) says that divorce takes place only after marriage.

Hazrat Ibn Abbas (may Allah be pleased with them) says that divorce takes place only after marriage, and emancipation takes place only after ownership.

Hazrat Aisha (may Allah be pleased with her) says that divorce takes place only after marriage. Hazrat Zuhri (may Allah have mercy on him) says that divorce will occur only when there is a marriage.

Hazrat Ibn Abbas (may Allah be pleased with both of them) said: I do not care whether I marry a woman or place my hand on this pillar, meaning it is permissible.

It is narrated from Hazrat Jabir (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "There is no divorce before marriage."

Hazrat Saeed bin Jubair (may Allah have mercy on him) narrates that Marwan asked Hazrat Ibn Abbas (may Allah be pleased with them both) about this matter, so he replied that there is no divorce before marriage and no emancipation before ownership.

Hazrat Saeed bin Musayyib (may Allah have mercy on him) was asked: If a person says that the day I marry such-and-such woman, she is divorced, what is the ruling on this? He replied: This is nothing.

Hazrat Khallaf bin Khalifah (may Allah have mercy on him) says that I asked Mansur (may Allah have mercy on him) that if a man, while mentioning a woman, says that the day I marry her, she is divorced, then what is its ruling? He replied that Hasan (may Allah have mercy on him) did not consider it to be anything.

Hasan (may Allah have mercy on him) did not attach any importance to a man saying that the day he marries such-and-such woman, she will be divorced.

It is also narrated in the same way from Hazrat Ata and Hazrat Tawus d.

Hazrat Saeed bin Jubair (may Allah have mercy on him) was asked: If a person says that the day I marry such-and-such woman, she is divorced, what is the ruling on this? He replied: This is nothing; divorce takes place after marriage.

Hazrat Ali (may Allah be pleased with him) bin Husain (may Allah have mercy on him) says that there is no divorce before marriage.

Hazrat Ali (may Allah be pleased with him) bin Hussain (may Allah have mercy on him) says that divorce takes place after marriage.

It was mentioned before Hazrat Saeed bin Musayyib (may Allah have mercy on him) that someone said to an Ansari, "We have heard that you are sending a marriage proposal to such-and-such woman?" The Ansari replied, "If I marry her, she is divorced." Hazrat Saeed (may Allah have mercy on him) said, "In my opinion, this statement has no significance." Yahya (may Allah have mercy on him) says that Hazrat Urwah (may Allah have mercy on him) also held the same view.

Hazrat Shurayh (may Allah have mercy on him) says that divorce only takes place after marriage.
