Musannaf Ibn Abi Shaybah

Hazrat Ubaidullah bin Abi Ziyad (may Allah have mercy on him) asked Hazrat Abdullah bin Abbas (may Allah be pleased with them both) that if a man buys a slave woman and she is pregnant, can he have intercourse with her? He replied, "No." Then he recited the verse of the Holy Qur'an: "The waiting period of pregnant women is that they give birth to their child."

Hazrat Dawood, may Allah have mercy on him, says that I asked Hazrat Sha’bi, may Allah have mercy on him, that Hazrat Abu Musa, may Allah be pleased with him, had said on the day of the conquest of Tustar that no intercourse should be had with a pregnant woman and there should be no sharing in the offspring of the polytheists, because the water (semen) increases in the child. Did he say this from his own opinion or did he narrate it from the Messenger of Allah, peace and blessings be upon him? He replied that the Messenger of Allah, peace and blessings be upon him, had said on the day of the conquest of Autas that no intercourse should be had with a pregnant woman before the birth of her child, and with other women until it is known that their wombs are empty.

It is narrated from Hazrat Abu Qilabah (may Allah have mercy on him) that the Messenger of Allah (peace and blessings be upon him) said: Whoever has intercourse with a pregnant woman is not one of us.

The same is also narrated from Hazrat Ibn Abbas (may Allah be pleased with them both).

Hazrat Abu Marzuq, may Allah have mercy on him, the freed slave of Tujib, says that we fought towards the west with Hazrat Ruwaifi’ bin Thabit Ansari, may Allah be pleased with him. We conquered a village named Jarbah, so Hazrat Ruwaifi’, may Allah be pleased with him, addressed us and said: I will tell you something which I heard from the Messenger of Allah, peace and blessings be upon him. On the day of the conquest of Khaybar, he said: Whoever believes in Allah and the Last Day should not irrigate someone else’s crop with his water.

It is narrated similarly through another chain.

Hazrat Ali (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) forbade intercourse with a pregnant woman before she gives birth, and with a non-pregnant woman before it is certain that her womb is clean through menstruation.

Hazrat Sillah, Hazrat Qatham, and Hazrat Najiyah bin Ka'b (may Allah be pleased with them) state that when a person buys a pregnant slave woman, he should not have intercourse with her before she gives birth. And if he buys a non-pregnant one, he should not go near her until she has her menstrual period.

Hazrat Saeed bin Musayyib (may Allah have mercy on him) says that it has been prohibited for a man to have intercourse with a slave-girl or woman who is pregnant with another man's child.

Hasan (may Allah have mercy on him) narrates that when Tustar was conquered, some slave women came into the possession of Abu Musa (may Allah be pleased with him). Umar (may Allah be pleased with him) wrote him a letter with this order: No person should have intercourse with any woman before she gives birth; do not become partners in the offspring of the polytheists, for the water (semen) completes the child.

Hazrat Tawus (may Allah have mercy on him) narrates that the Messenger of Allah (peace and blessings be upon him) had a caller announce during a battle that intercourse should not be done with a pregnant woman until she gives birth, and with a non-pregnant woman until she has her menstrual period.

Hazrat Abu Umamah (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) forbade intercourse with a pregnant woman before she had given birth during the Battle of Khaybar.

It is narrated from Hazrat Abu Darda (may Allah be pleased with him) that on the occasion of a battle, the Prophet ﷺ passed by a pregnant woman who was near childbirth (and had been brought as a captive). She was standing at the entrance of the tent. The Prophet ﷺ inquired, "Whose is she?" The people replied, "She belongs to so-and-so." The Prophet ﷺ asked, "Does he have intercourse with her?" The people replied, "Yes." The Prophet ﷺ said, "I am inclined to invoke such a curse upon him that it would accompany him in his grave. How will he take service from (the child born from) her when he is strengthening its hearing and sight? How will he be its heir when it is not lawful for him?"
