Musannaf Ibn Abi Shaybah

Hazrat Sha'bi and Hasan (d) state that it is permissible for a sick person to marry and to buy and sell.

Ibrahim (may Allah have mercy on him) was asked whether it is permissible for a sick person to marry. He replied that it is permissible except in the case of one who is terminally ill.

Hazrat Hakam (may Allah have mercy on him) states that Abdur Rahman ibn Umm al-Hakam (may Allah have mercy on him), while in the illness of death, intended to marry the daughter of Jarir in exchange for one-eighth of his wealth, but she refused. And when, during the illness, he intended the dowry to be one-third of his wealth, then this marriage was considered valid.

Hazrat Sha'bi (may Allah have mercy on him) says that Hazrat Muawiyah (may Allah be pleased with him) declared it permissible.

Hazrat Abdullah bin Yazid Bahili (may Allah have mercy on him) narrates that he asked Hazrat Ata (may Allah have mercy on him) about a person who marries while in the state of terminal illness. He replied that people say it is permissible.

Hasan (may Allah have mercy on him) said that if a person, during his terminal illness, marries with the intention of harming the heirs, then this is not permissible; but if he marries for the purpose of service, then it is permissible.

Hazrat Hammad (may Allah have mercy on him) says that in the illness of death, it is permissible to marry in exchange for one-third of the wealth.

Hazrat Ibn Jurayj (may Allah have mercy on him) says that I asked Hazrat Ata (may Allah have mercy on him) about a sick person getting married, so he replied that this is, in my view, a new matter.

Hazrat Zuhri says that it is not permissible to marry during the illness of death.

Hazrat Khalifah bin Ghalib (may Allah have mercy on him) says that I asked Hazrat Nafi' (may Allah have mercy on him) about marriage during the illness of death, so he replied that it is permissible. She will also be an heir and will also receive the dowry.

Hazrat Nafi' (may Allah have mercy on him) narrates that Ibn Abi Rabee'ah (may Allah have mercy on him) married a woman while he was in the state of illness leading to death; he wanted to make her his heir. There was a relationship between him and that woman.
