ما قالوا في المرأة تزوج ولها زوج تجيء بولد، لمن الولد منهما؟
If a Woman Marries While Still Married (by Mistake) and Has a Child, Whose Child Is It?
Hadith 18155
١٨١٥٥ - حدثنا أبو بكر قال: (حدثنا) (١) حفص عن أشعث عن الحسن في المرأة تزوج ولها زوج قال: إن جاءت به وهو يشك فيه فهو للأول، وإن جاءت به وهو لا يشك فيه فهو للآخر.
Hasan (may Allah have mercy on him) said that if a woman (by mistake) got married while she already had a husband, and then a child was born, if the second husband has doubt, then the child will belong to the first husband, and if he does not have doubt, then the child will belong to the second husband.
Hadith 18156
١٨١٥٦ - حدثنا الضحاك بن مخلد عن ابن جريج عن عطاء في رجل طلق امرأته وتزوجها آخر (١) وقد حاضت حيضة: (الولد) (٢) للآخر.
Hazrat Ata (may Allah have mercy on him) says that a man divorced his wife, then another man married that woman during her waiting period (‘iddah), and the woman had already menstruated, so the child will belong to the second man.
