Musannaf Ibn Abi Shaybah

Hazrat Umar bin Abdul Aziz (may Allah have mercy on him) says that if a man marries a woman and then divorces her in a state of illness before consummation, she will receive half the dowry, will not receive inheritance, and the waiting period (iddah) will not be obligatory upon her.

It is narrated similarly through another chain of transmission.

18144 - 'Abdah and Muhammad ibn Suwa' narrated to us from Sa'id (from) (1) Abu Ma'shar from Ibrahim who said: She has half the dowry, no inheritance for her, and no 'iddah upon her.

Hazrat Zuhri (may Allah have mercy on him) says that if a man marries a woman and then, before consummation, divorces her while in a state of illness, then that woman will not be an heir, there will be no waiting period (iddah) for her, and she will receive half of the dowry (mahr).

Hazrat Jabir bin Zaid (may Allah have mercy on him) says that if a man marries a woman and then, before consummation, divorces her while in a state of illness, she will receive the full dowry, will not receive inheritance, and the waiting period (iddah) will not be obligatory.

Hazrat Qatadah (may Allah have mercy on him) used to say the same.

Hasan (may Allah have mercy on him) says that if a man marries a woman and then, before consummation, divorces her while in a state of illness, she will receive the full dowry, inheritance, and the waiting period (iddah) will also be obligatory.

Hazrat Harith (may Allah have mercy on him) says that if a man marries a woman and then, before consummation, in a state of illness, gives her three divorces or one divorce, then that woman will not receive inheritance.

Hazrat Sha'bi (may Allah have mercy on him) says that if a man marries a woman and then, before consummation, divorces her while in a state of illness, she will not receive inheritance.
