Musannaf Ibn Abi Shaybah

Hazrat Ibn Abbas (may Allah be pleased with both of them) was asked: If a man marries a slave woman, then before consummation he sets her free, and according to Islamic law the woman is given the choice to accept or reject her husband, but she chooses separation from her husband, will she receive a dowry? He replied: She will not receive anything; she cannot obtain both her person and the dowry.

Hasan (may Allah have mercy on him) used to say that if a slave woman was married to a slave man, then she was set free, and after being freed she was given the choice, and she chose herself before consummation, then that woman will not receive a dowry and this will be an irrevocable divorce.

Ibrahim (may Allah have mercy on him) said that if a man married his slave woman with a specified dowry, then she was set free before consummation, then she was given the option and she chose herself, the marriage will become void and the dowry will be returned to her husband.
