Can the Former Husband Have Relations with a Slave Woman Now in His Ownership?
Hadith 16903
١٦٩٠٣ - حدثنا أبو بكر قال: نا ابن إدريس عن ليث عن طاوس ققال: هي (مما) (١) ملكت يمينه.
Hazrat Tawus says that now she is his slave-girl.
Hadith 16904
١٦٩٠٤ - حدثنا عباد بن عوام سعيد عن قتادة عن الحسن قال: يطأها بملك اليمين.
Hasan says that now, on the basis of ownership, he can have intercourse with her.
Hadith 16905
١٦٩٠٥ - حدثنا عبد الأعلى عن هشام عن محمد عن حميد بن عبد الرحمن قال: أحلتها آية وحرمتها آية أخرى، ولا آمرك ولا أنهاك.
Hazrat Humaid bin Abdur Rahman says that the first verse { وأحل لکم ماوراء ذالکم } made it lawful. The second verse { حتی تنکح زوجا غیرہ } made it unlawful. I neither command you nor forbid you.
Hadith 16906
١٦٩٠٦ - حدثنا عبد الأعلى عن سعيد عن قتادة عن سعيد بن المسيب قال: (ليس) (١) له أن يغشاها بملك اليمين، وإن شاء أعتقها (وتزوجها) (٢)، وكانت عنده على واحدة.
Hazrat Saeed bin Musayyib says that due to ownership, he cannot have intercourse with her; if he wishes, he can free her and then marry her. Then he will have the right to only one divorce. This was also the opinion of Hazrat Qatadah.
Hadith 16908
١٦٩٠٨ - حدثنا عبد الأعلى عن سعيد عن قتادة عن جابر وأبي سلمة مثله.
It is also narrated in the same way from Hazrat Jabir and Hazrat Abu Salamah.
