Musannaf Ibn Abi Shaybah

It is narrated from Hasan that the Messenger of Allah (peace and blessings be upon him) forbade marrying a slave woman while having a free woman as a wife.

Hasan says that one should not marry a slave woman while a free woman is available. If someone does so, he will not be left in that state.

Hazrat Mak'hool says that a man cannot marry a slave woman while he is free, but a slave woman can marry a free man.

Hazrat Ali (may Allah be pleased with him) says that a man cannot marry a slave woman while he is free, but a slave woman can marry a free man.

Hazrat Masrooq says that only a slave can marry a slave woman while a free woman is available.

Hazrat Abdullah (may Allah be pleased with him) says that only a slave can marry a slave woman while a free woman is present.

Hazrat Saeed bin Musayyib says that a man cannot marry a slave woman while he is free, but a free woman can marry while being with a slave.

Hazrat Ata says that if a man marries a free woman while he has a slave woman, then this is good.

Hazrat Ibn Tawoos says that I asked my father, "Can a man, while being free, marry a slave woman? People think that doing so is forbidden (ihraam)?" Hazrat Tawoos replied, "People are correct."

Hazrat Saeed bin Musayyib and Hasan were asked: If a person marries a slave woman while having a free woman (as his wife), what is the ruling? They replied: Separation will be enforced between that person and the slave woman.

Hazrat Zuhri was asked: What is the ruling if a person marries a slave woman while having a free woman (as his wife)? He replied: That person's back will be punished and separation will be made between the two.
