Musannaf Ibn Abi Shaybah

Hazrat Ziyad bin Alaqah narrates that a man sent a marriage proposal to a previously married woman from the tribe of Banu Laith. Her father refused to marry her off. The woman wrote a letter to Hazrat Uthman (may Allah be pleased with him), so Hazrat Uthman (may Allah be pleased with him) wrote a letter and ordered that if the man is a suitable match for the woman, then tell her father to marry her off. If he does not arrange the marriage, then still have her married.

Hasan says that if there is a disagreement between the guardian and the ruler, then the ruler will see: if the guardian is harming the woman, then the woman's statement will be considered valid, and if this is not the case, then the matter will be entrusted to the guardian.

Hazrat Abu Ja'far Ashja'i says that a woman came to Hazrat Shurayh with her mother and her uncle. Her mother wanted to marry her to one man, and her uncle wanted to marry her to another man. Hazrat Shurayh gave the woman the choice, and the woman chose her mother's preference. Hazrat Shurayh asked her uncle, "Do you give permission?" He said, "By Allah! I will never give permission." Hazrat Shurayh said, "Do you give permission before your permission is no longer required?" Her uncle said, "By Allah! I will never give permission." Hazrat Shurayh said to the woman's mother, "Take your daughter and marry her to whomever you wish."
