Musannaf Ibn Abi Shaybah

It is narrated from Hazrat Uqbah bin Aamir (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: When two guardians arrange a marriage, the marriage of the first is valid.

It is narrated from Hazrat Samurah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: When two guardians conduct a marriage, the marriage of the first is valid.

Ibrahim narrates that if a woman’s marriage was conducted in Kufa by a guardian named “Ubaidullah,” while a man in Syria had already married her before Ubaidullah, whose marriage would be valid? When the man from Syria came to Kufa, he brought this case before the court of Hazrat Ali (may Allah be pleased with him). Hazrat Ali (may Allah be pleased with him) ruled in favor of the first, even though she had already borne a child from the second.

Ibrahim says that in the previous narration, "Ubaidullah" is meant by "the former."

Hazrat Shurayh says that when two guardians conduct a marriage, the marriage conducted by the first is valid.

Hazrat Shurayh says that if two guardians have married off a woman, the woman will be given the choice.

Muhammad says that when two guardians perform a marriage, the marriage performed by the first is valid.

Hazrat Thabit bin Qais Ghafari narrates that I wrote a letter to Hazrat Umar bin Abdul Aziz stating that a girl from the Juhaina tribe was married by her guardian to a man from the Qais tribe, while her brother married her to a man from the Juhaina tribe. Now, whose wife will she be? Hazrat Umar bin Abdul Aziz replied: Bring just witnesses before her, then give her the choice; whoever she chooses, he will be her husband.

Hazrat Aamir says that if two brothers have married off their one sister to different places, then she will have the choice regarding both.

Hazrat Hammad says that if two guardians have married a woman to someone, then the one whom she is pleased with, he is her husband.
