Musannaf Ibn Abi Shaybah

Ibrahim says that if someone is made to swear an oath of divorce and he swears it, then the oath applies to the one upon whom the person making him swear intended it, and the intention of the one making him swear is not considered in this matter.

Hasan says that if a person makes someone swear an oath, believing that he is not already under oath, then this is a binding oath.

Ibrahim says: The intention of the one who administers the oath is to be considered in the oath.

It is narrated from Hazrat Abu Huraira (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said: The oath is according to the intention of the one who asks for it to be sworn.

Hazrat Umar says that your oath is based on that which your companion has declared you truthful upon.
