Musannaf Ibn Abi Shaybah

Hazrat Amr bin Shu'aib narrates from his father and grandfather that the Noble Prophet (peace and blessings be upon him) said: On the land irrigated by running water, 'ushr (one-tenth) is due, and on the land irrigated by drawing water with camels, half of 'ushr (one-twentieth) is due.

It is narrated from Imam Sha'bi that the Holy Prophet, peace and blessings be upon him, wrote to the people of Yemen: For land that is irrigated by rain from the sky or by flowing water, and produces wheat, barley, raisins, or dates, one-tenth (ushr) is due on it. And for land that is irrigated by drawing water with camels, half of one-tenth (half ushr) is due on it.

It is narrated from Hazrat Hakam that the Holy Prophet (peace and blessings be upon him) wrote to Hazrat Mu'adh in Yemen: On the land irrigated by rainwater or flowing water, 'ushr (one-tenth) is due, and on the land irrigated by camels or by buckets, half of 'ushr (one-twentieth) is due.

It is narrated from Hazrat Salih bin Abu Al-Khalil that the Holy Prophet, peace and blessings be upon him, established the rule that for any land irrigated by rainwater, a flowing spring, or by camels, or for land that does not require water but receives moisture from the earth, the full tithe (one-tenth) is due on all of them. And for land irrigated by a rope (bucket), half of the tithe (one-twentieth) is due on that land.

Hazrat Ali (may Allah be pleased with him, may Allah honor his face) said: The land that is irrigated by rainwater or flowing water is subject to 'ushr (one-tenth), and the land that is irrigated by water drawn with a bucket is subject to half of 'ushr (one-twentieth).

It is narrated from Hazrat Qatadah that the Noble Prophet (peace and blessings be upon him) established the rule that for land irrigated by rain, a flowing spring, or by camels, or for land that does not require water and receives moisture from the earth, the full tithe (one-tenth) is due on all of them. And for land irrigated by rope (bucket), half of the tithe (one-twentieth) is due. And Hazrat Qatadah used to say that for fruits that are measured by volume, either the full tithe or half tithe is due.

It is narrated from Hazrat Nafi that Hazrat Ibn Umar (may Allah be pleased with them both) said that there is zakat on fruits and zakat on crops, whether it is dates, wheat, barley, or any type of barley, or if it is irrigated by a canal, or irrigated by spring water, or irrigated by rainwater, on all of these is ‘ushr, that is, one-tenth out of ten. And on land that is irrigated by buckets, there is half ‘ushr, that is, one out of twenty. The Noble Prophet (peace and blessings be upon him) wrote and sent to Harith bin Abd Kallal and other people in Yemen that the wealth (land) of the believers which is irrigated by spring water or by rainwater, on it is ‘ushr, and that which is irrigated by buckets, on it is half ‘ushr.

Hazrat Ibn Jurayj says that I asked Hazrat Ata whether the land that is irrigated by channeling water from wells—whether it is for dates, grapes, or other crops (grains)—does it have the same ruling? He replied: It is subject to ‘ushr (one-tenth).

Hazrat Ibn Jurayj says that Abu Zubair told me that he heard from Hazrat Jabir that there is 'ushr in it.

Hazrat Ibn Jurayj says that I asked Hazrat Ata: What is the ruling regarding the date palm (orchard) that is irrigated without effort, or crops and grains that are irrigated by rainwater? He replied: Ushr (one-tenth). I asked: What is the ruling if dates, grapes, and grains are irrigated by running water? He replied: Ushr (one-tenth). I asked: What is the ruling for land that is irrigated by buckets and camels? He replied: Half of Ushr (one-twentieth).

Hazrat Ibn Jurayj states that Abu Zubair informed me that Hazrat Jabir bin Abdullah (may Allah be pleased with him) said that half of a tenth is due.

It is narrated from Hazrat Muammar that Hazrat Imam Zuhri does not specify any fixed amount for fruits. He says that it is either ‘ushr’ or half ‘ushr’.

It is also narrated in the same way from Hazrat Mujahid.

Hazrat Muammar narrates that Hazrat Umar bin Abdul Aziz had written the same (order) to the people of Yemen.

Hasan says that when wheat, barley, dates, and grapes reach five wasq, and five wasq is three hundred sa’, then if they are irrigated by oneself, half of a tenth (half ‘ushr) is due on them, and if they are irrigated by rainwater or spring water, then a tenth (‘ushr) is due on them.

It is narrated from Hazrat Nafi’ that Hazrat Abdullah used to give the verdict regarding the zakat of fruits and crops that for that which is irrigated by river or spring water, or by rainwater, or by means of a camel, the zakat is ‘ushr, that is, one out of every ten. And for that which is irrigated by means of a pond (by lifting and carrying water), the zakat is half of ‘ushr, that is, one out of every twenty.
