العبد يخرج قبل سيده من دار الحربA Slave Who Escapes from Dar al-Harb Before His Master
Hadith 35845
٣٥٨٤٥ - حدثنا أبو معاوية عن حجاج عن أبي سعيد (الأعسم) (١) أن رسول اللَّه ﷺ قضى في العبد وسيده قضيتين: قضى في العبد إذا خرج من دار الحرب قبل سيده (فهو حر) (٢)، فإن خرج سيده بعده لم (يرده) (٣) عليه وإن خرج السيد قبل العبد من دار الحرب ثم خرج العبد بعده (رده) (٤) على سيده (٥).
It is narrated from Hazrat Abu Saeed Al-Asam (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) gave a ruling regarding a slave: if he leaves the land of war (Dar al-Harb) before his master, he is free, and if later his owner comes, he will not be returned. But if the owner comes out of Dar al-Harb before the slave, and then the slave comes after him, then the slave will be given to the master.
