الرجل يسلم وهو في دار الحرب فيقتله الرجل (وهو ثم)Someone Accepts Islam in Enemy Territory and Is Killed There
Hadith 35673
٣٥٦٧٣ - حدثنا جرير عن مغيرة عن إبراهيم قال: ﴿فَإِنْ كَانَ مِنْ قَوْمٍ عَدُوٍّ لَكُمْ وَهُوَ مُؤْمِنٌ﴾ [النساء: ٩٢]، الرجل يُقتل وقومه مشركون، ليس بينهم وبين رسول اللَّه ﷺ عهد، فتحرير رقبة مؤمنة، فإن قتل مسلم من قوم مشركين وبينهم وبين رسول اللَّه ﷺ عهد، فعليه رقبة مؤمنة، وتؤدى ديته إلى قومه الذين بينهم ⦗٤٦٤⦘ وبين رسول اللَّه ﷺ عهد، فيكون ميراثه للمسلمين ويكون عقله عليهم (لقومه) (١) المشركين الذين بينهم وبين رسول اللَّه ﷺ عهد، فيرث المسلمون ميراثه ويكون عقله لقومه؛ لأنهم يعقلون عنه.
Ibrahim, regarding the verse of the Holy Qur'an { فَإِنْ کَانَ مِنْ قَوْمٍ عَدُوٍّ لَکُمْ وَہُوَ مُؤْمِنٌ}, says that if a man is killed and his people are polytheists, and there is no treaty between him and Allah's Messenger ﷺ, then a believing slave will be freed. And if a Muslim kills such a polytheist with whom there is a treaty between him and the Messenger of Allah ﷺ, then a believing slave must be freed, and the blood money will be given to his people with whom there was a treaty with the Messenger of Allah ﷺ. His inheritance will go to the Muslims, and his blood money will be upon the Muslims for his polytheist people with whom there is a treaty with Allah's Messenger ﷺ. The Muslims will inherit his inheritance. His blood money will be upon his people because they pay the blood money on his behalf.
