Hadith 33337
٣٣٣٣٧ - حدثنا وكيع قال: ثنا سفيان عن الأعمش عن إبراهيم قال: كان عبد اللَّه يقاسم بالجد الإخوةَ إلى الثلث، ويعطي كل صاحب فرض فريضته، ولا يورث الإخوة من الأم مع الجد، (ولا يقاسم) (١) (بالإخوة) (٢) للأب الإخوة للأب والأم (مع الجد) (٣)، وإذا كانت أخت لأبٍ وأم (وأخت) (٤) لأب وجد أعطى الأخت من الأب والأم النصف والجد النصف، وكان علي يقاسم بالجد الإخوة إلى السدس، ويعطي كل صاحب فريضة فريضته، ولا يورث الإخوة من الأم مع الجد، ⦗٣٠١⦘ (ولا يقاسم بالإخوة للأب الإخوة للأب والأم) (٥)، ولا يزيد الجد مع الولد (على) (٦) السدس إلا أن لا يكون غيره، فإذا كانت أخت لأب وأم وأخ لأب وجد أعطى الأخت النصف، وجعل النصف بين الجد والأخ، وكان زيد يقاسم بالجد الإخوة والأخوات إلى الثلث، فإذا بلغ الثلث أعطاه الثلث، وكان للإخوة والأخوات ما بقي، ولا يورث الإخوة من الأم مع الجد ولا يقاسم بهم، وكان يقاسم الإخوة للأب الإخوة للأب والأم ولا يورثهم شيئًا، وإذا كانت أخت لأب وأم وأخ وأخت لأبٍ، وجدٌ أعطى الأخت من الأب والأم النصف، وقاسم الأخ والأخت الجد (٧).
Ibrahim says that Abdullah (may Allah be pleased with him) used to include the grandfather with the brothers in the division of wealth, and used to give every rightful person his due, and would not make the maternal brother an heir in the presence of the grandfather, and in the case of the participation of full brothers with the grandfather in the division, he would not give the paternal brother a share in the division, and when a full sister, a paternal sister, and the grandfather were together, he would give half the wealth to the full sister and half to the grandfather. And Ali (may Allah be pleased with him) used to include the grandfather with the brothers in the division of wealth up to one-sixth, and would give every rightful person his due, and would not make the maternal brother an heir in the presence of the grandfather, and in the presence of children, would not give the grandfather more than one-sixth of the wealth, except if there was no other heir besides the grandfather. So when a full sister, a paternal brother and sister, and the grandfather were together, he would give half the wealth to the full sister and include the brother and sister with the grandfather in the division. Abu Bakr says that this issue will be resolved in two ways according to the statements of Ali (may Allah be pleased with him) and Abdullah (may Allah be pleased with him), and in three ways according to the statement of Zaid (may Allah be pleased with him).
