٣٣١٤٩ - حدثنا ابن فضيل عن بسام عن فضيل عن إبراهيم في رجل ترك ابنتيه وابنة ابن وابن ابن أسفل منها، فلابنتيه الثلثان، وما فضل لابن ابنه، يرد على من فوقه ومن معه من البنات في قول علي وزيد: للذكر مثل حظ الأنثيين، ولا يرد على من أسفل منه، وفي قول عبد اللَّه لابنتيه الثلثان ولابن ابنه ما بقي، لا يرد على (أخته) (١) شيئًا ولا على من فوقه من أجل أنه استكمل الثلثين (٢).
Ibrahim states regarding the man who left behind two daughters, a granddaughter, and a great-granddaughter, that his daughters are entitled to two-thirds of the estate, and the remainder is for the great-granddaughter, in such a way that the estate will also be returned to the sisters above her and alongside her. According to the opinion of Hazrat Ali (may Allah be pleased with him) and Zaid bin Thabit (may Allah be pleased with him), a male will be given a share equal to that of two females, and the estate will not be returned to anyone below this. According to the statement of Hazrat Abdullah (may Allah be pleased with him), two-thirds of the estate is for the two daughters of this man, and the remainder is for his grandson; the remainder will not be returned to his sister, nor will anything be returned to any woman above this grandson, because these sisters have already received the full two-thirds. Hazrat Abu Bakr states that this issue, according to the opinion of Hazrat Ali (may Allah be pleased with him) and Hazrat Zaid (may Allah be pleased with him), will be resolved out of nine shares: two-thirds of the estate will be for the daughters, and three shares will remain, of which two shares will be for the grandson and one share for the sister. According to the opinion of Hazrat Abdullah (may Allah be pleased with him), it will be resolved out of three shares: two-thirds for the daughters and the remaining one-third for the grandson.
