في الرجل يوصي لعبده بثلثهOne Who Bequeaths a Third of His Wealth to His Slave
Hadith 33072
٣٣٠٧٢ - حدثنا يحيى بن آدم قال: ثنا سنان بن هارون البرجمي عن أشعث عن الحسن وابن سيرين قالا في رجل أوصى لعبده بالثلث، قالا: ذلك من رقبته، فإن كان الثلث أكثر من ثمنه عتق ودفع إليه ما بقي، وإن كان أقل من ثمنه عتق وسعى لهم فيما بقي وإن أوصى لهم بدراهم فإن شاء الورثة أجازوا، وإن شاءوا لم يجيزوا.
It is narrated from Ash'ath that Hasan and Muhammad bin Sirin said regarding the man who made a bequest of one third of his wealth for his slave, that this wealth will be given from his own share, so if one third is more than the value of the slave, then the slave will be set free and the remaining wealth will be given to him, and if it is less than his value, then he will be set free and the remaining value will be earned for the heirs, and if a deceased person made a bequest to give dirhams to slaves, then if the heirs wish, they may execute this bequest, and if they wish, they may not execute it.
