Musannaf Ibn Abi Shaybah

Hazrat Shaibani states that Hazrat Sha'bi, Hazrat Hakam, and Hazrat Hammad said: Whoever is struck with a whip, a stick, or a stone, and this striking was less than what would cause death intentionally, then this will be considered intentional (murder); its compensation will be retribution (qisas).
