الرجل يقتص له أيحبس؟Regarding the Man for Whom Qisas Is Being Taken: Should He Be Imprisoned?
Hadith 29768
٢٩٧٦٨ - حدثنا أبو بكر قال: حدثنا محمد بن بكر عن ابن جريج قال: قال عطاء: (للجروح) (١) قصاص، وليس للإمام أن يضربه ولا أن يحبسه، إنما هو القصاص، ما كان اللَّه نسيًا، لو شاء لأمر بالسجن والضرب.
Hazrat Ibn Jurayj states that Hazrat Ata said: There is also qisas (retaliation) in wounds, and the Imam does not have the authority to kill him or imprison him. Indeed, this is qisas, and Allah, the Lord of Honor, does not forget anything. If He had willed, He would have commanded imprisonment and killing.
