من قال: إذا كان الرهن عند المرتهن فهو أحق (به) من سائر الغرماءThe Pawnee Has More Right When the Pawn Is with Him Than Other Creditors
Hadith 24429
٢٤٤٢٩ - حدثنا أبو بكر قال: حدثنا ابن إدريس عن هشام عن الحسن قال: إن الرهن المقبوض إذا مات صاحبه أو أفلس فالذي (هو في يده) (١) أحق به، فإن لم يكن مقبوضا فهو بين الغرماء.
Hasan says that if there is possession of the pledged item and its owner dies or becomes insolvent, then the one who has possession of it has more right to it, and if there is no possession, then it will be distributed among the creditors.
