Hadith 24330
٢٤٣٣٠ - حدثنا أبو بكر قال: حدثنا ابن أبي زائدة عن ابن عون عن محمد قال: (قلت) (١) (لشريح) (٢): كفيلي حيل دونه، ومالي اقتضي مسمى، و (مال) (٣) غريمي اقتسم دوني، فقال: إن كان (الكفيل) (٤) (مخيرا) (٥) فالكفيل غارم، وإن كان مالك اقتضي مسمى، فأنت أحق به، وإن كان مال غريمك اقتسم دونك فهو بالحصص.
Muhammad, may Allah have mercy on him, says: I submitted to Hazrat Shurayh: My guarantor acted with trickery apart from me, and a judgment was made regarding my wealth, and the wealth of my debtor was distributed apart from me. He said: If the guarantor had the choice, then he is liable, and you have more right to your wealth, and if your debtor's wealth was distributed apart from you, then it will be according to the shares.
