Hadith 24112
٢٤١١٢ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا سعيد بن حسان قال: سمعت مجاهدًا يقول: (من أُعمر) (١) عمرى فهي له ولورثته من بعده، لا ترجع إلى الذي أعمرها، والرقبى مثلها، قلت لمجاهد: ما الرقبى؟ قال: قول الرجل: هي (للآخر) (٢) مني ومنك.
Hazrat Mujahid (may Allah have mercy on him) said: Whoever receives a house as 'Umri', it will belong to him during his lifetime, and after his death, it will go to his heirs. Such a house will not return to the one who gave it as 'Umri', and 'Ruqba' is also similar to this. I asked Mujahid (may Allah have mercy on him) what is the meaning of 'Ruqba'? He replied: 'Ruqba' is when a person says that this house will belong to whichever of us lives longer.
