Hadith 24075
٢٤٠٧٥ - حدثنا أبو بكر قال: حدثنا هشيم عن يونس عن الحسن أنه كان ⦗٤١٢⦘ يقول: إذا اشترى الرجل المتاع على أنه فيه بالخيار، فهلك من عنده، قال: إن كان سمى الثمن فهو (له ضامن، وإن لم يكن سمى الثمن فهو) (١) فيه مؤتمن.
Hasan says that if a person buys goods with the option of choice (khiyar), then they are destroyed while with him, if he has fixed the price, he will be liable; and if he has not fixed the price, then he is a trustee. (There is no liability on a trust.)
