٢١٨٣٣ - حدثنا أبو بكر قال: حدثنا جرير عن مغيرة عن الحارث في الرجل يدعي الدابة في يد الرجل فيقول: ضلت مني، قال: لا أقول للشهود: إنه لم (يبع ولم يهب) (١)، ولكن إذا شهدت الشهود أنها دابته، ضلت منه، أحلّفه باللَّه: ما باع ولا وهب.
Hazrat Harith says that if a person claims about an animal in someone’s possession that “this is my animal which was lost from me,” then I would not ask the witnesses to testify that he neither sold it nor gifted it. Rather, when the witnesses testify that this is his animal which was lost, I will have the claimant swear an oath that he neither sold it nor gifted it.
