Musannaf Ibn Abi Shaybah

Hazrat Jabir bin Zaid (may Allah have mercy on him) narrates that there was a discussion between Hazrat Abdullah bin Abbas (may Allah be pleased with them both) and Hazrat Abdullah bin Umar (may Allah be pleased with them both) regarding the woman whose husband has gone missing. Both of them said that she will wait for four years, then the guardian of her husband will divorce her, then she will observe the waiting period (‘iddah) for four months and ten days. Then there was a discussion between the two regarding maintenance, so Hazrat Ibn Umar (may Allah be pleased with them both) said that the woman will receive maintenance from the man's wealth because she was held back due to him. Hazrat Ibn Abbas (may Allah be pleased with them both) said that it is not so, as this would cause loss to the heirs. However, the woman will take from the man's wealth, and if he returns, the wealth will belong to the woman, and if he does not return, then the woman will not receive anything.
