Hadith 19723
١٩٧٢٣ - حدثنا أبو بكر قال: نا عبدة بن سليمان عن يحيى بن سعيد قال: سألت سعيد بن المسيب عن (الرجل) (١) يطلق امرأته وهي (ببيت) (٢) بكراء (٣)، على من الكراء؟ قال: على زوجها، قال: فإن لم يكن عند زوجها (قال) (٤): (فعليها) (٥)، قال: فإن لم يكن عندها؟ قال: فعلى الأمير.
Yahya bin Saeed (may Allah have mercy on him) says that I asked Saeed bin Musayyib (may Allah have mercy on him): If a man divorces his wife and she is living in a rented house, upon whom is the rent obligatory? He replied: Upon her husband. I asked: If her husband does not have the means to pay the rent, then upon whom is it obligatory? He replied: Upon the woman. I asked: If the woman also does not have the means, then upon whom is it obligatory? He replied: Upon the ruler.
