من كان لا يرى الخلع طلاقاThose Scholars Who Do Not Consider Khul as Divorce
Hadith 19481
١٩٤٨١ - حدثنا أبو بكر قال: نا ابن عيينة عن عمرو عن طاوس عن (ابن) (١) عباس قال: إنما هو فرقه وفسخ، ليس بطلاق، ذكر اللَّه الطلاق في أول الآية وفي آخرها والخلع بين ذلك فليس بطلاق. . ﴿الطَّلَاقُ مَرَّتَانِ فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ﴾ [البقرة: ٢٢٩] (٢).
Hazrat Ibn Abbas (may Allah be pleased with them both) says that khula is only separation and annulment of marriage; it is not divorce. Allah Almighty has mentioned divorce at the beginning and end of the verse, and in between, khula is mentioned. Allah Almighty says { الطَّلاَقُ مَرَّتَانِ فَإِمْسَاکٌ بِمَعْرُوفٍ ، أَوْ تَسْرِیحٌ بِإِحْسَانٍ } [البقرۃ ٢٢٩]
