Hadith 18336
١٨٣٣٦ - حدثنا أبو بكر قال: نا يحيى بن سعيد عن سفيان عن الأعمش (عن مسلم) (١) عن مسروق قال: كانت المرأة إذا ذهبت إلى المشركين أعطوا زوجها مثل مهرها، وإذا ذهبت إلى قوم ليس (بينها) (٢) وبينهم عهد من المشركين (فعاقبتم) فأصبتم غنيمة ﴿فَآتُوا الَّذِينَ ذَهَبَتْ أَزْوَاجُهُمْ مِثْلَ مَا أَنْفَقُوا﴾ [الممتحنة: ١١]، (يقول) (٣): (آتوا) (٤) زوجها من الغنيمة مثل مهرها.
Hazrat Masruq (may Allah have mercy on him) says that when a woman falls into the hands of the polytheists, her husband should be given the equivalent dowry. And when a woman goes to a people with whom there is no treaty between them and the polytheists, and war booty is obtained, then their husbands should be given the equivalent dowry from the booty.
