Hadith 7168

قَالَ ابْنُ شِهَابٍ : فَأَخْبَرَنِي مَنْ سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ ، قَالَ ، كُنْتُ فِيمَنْ رَجَمَهُ بِالْمُصَلَّى ، رَوَاهُ يُونُسُ ، وَمَعْمَرٌ ، وَابْنُ جُرَيْجٍ ، عَنِ الزُّهْرِيِّ ، عَنْ أَبِي سَلَمَةَ ، عَنْ جَابِرٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الرَّجْمِ .

Hadith Commentary:
He was stoned near the Eid prayer ground.
This person is Ma'iz bin Malik al-Aslami al-Madani, who was stoned by the order of the Prophet (sallallahu alayhi wa sallam).

Hadith Commentary:

Establishing the prescribed punishment (hadd) in the mosque does not preserve the sanctity and respect of the mosque.
It is possible that, at the time of carrying out the punishment, something may occur from the criminal
which is contrary to the etiquette of the mosque.
On this basis, the Messenger of Allah (sallallahu alayhi wa sallam) said regarding Ma‘iz bin Malik (radi Allahu anhu):
“Take him out of the mosque and stone him there.”
Accordingly, he was stoned outside the mosque, at the Eid ground.


The Messenger of Allah (sallallahu alayhi wa sallam) objected for this reason: he (sallallahu alayhi wa sallam) wished to conceal the matter, because there was no witness regarding it.
When he (Ma‘iz) confessed four times and testified against himself, the Prophet (sallallahu alayhi wa sallam) ordered the prescribed punishment to be carried out.
Ibn Battal says that prescribed punishments should not be established in mosques. In this regard, two hadiths are also narrated that prescribed punishments should not be established in the mosque, but they are not authoritative; rather, they are weak.
