Hadith Commentary:
➊
The position of Umar, Ibn Umar, and Zayd ibn Thabit (radi Allahu anhum) was that the Farewell Circumambulation (tawaf al-wada‘) is obligatory even for a menstruating woman. However, Ibn Umar and Zayd ibn Thabit (radi Allahu anhuma) retracted this position, but due to lack of knowledge of the aforementioned hadith, it is not established that Umar (radi Allahu anhu) retracted his position.
In any case, tawaf al-wada‘ is obligatory, but it is waived for a menstruating woman, and there is no expiation (fidya) or anything else upon her.
➋
Imam al-Bukhari (rahimahullah) previously established a chapter in the Book of Menstruation with the following words:
(Chapter: A woman who menstruates after the tawaf al-ifadah)
That is, “Regarding a woman who experiences menstruation after performing the tawaf al-ifadah.”
The position of all the noble Companions (radi Allahu anhum) was that if a woman performed the tawaf al-ifadah before menstruation, then she does not need to perform the tawaf al-wada‘; she may return to her homeland if she wishes. However, Umar (radi Allahu anhu) did not permit this. Thus, Harith al-Thaqafi (radi Allahu anhu) says that he asked Umar (radi Allahu anhu), and he replied:
“She should perform the tawaf al-wada‘ and then return.”
Harith (radi Allahu anhu) said that the Messenger of Allah (sallallahu alayhi wa sallam) instructed him in this manner.
(Sunan Abi Dawud, Manasik, Hadith: 2004)
However, the hadith of Aisha and the hadith of Umm Sulaym indicate that the obligation of tawaf al-wada‘ is abrogated for a menstruating woman.
And Allah knows best.
➌
Imam al-Bukhari (rahimahullah) has narrated the hadith of Ikrimah with extreme brevity.
The corroboration of Khalid al-Hadha’ mentioned has been narrated with a connected chain by Imam al-Bayhaqi, and the corroboration of Qatadah has been narrated by Abu Dawud al-Tayalisi, that there was a difference of opinion between Ibn Abbas and Zayd ibn Thabit (radi Allahu anhuma) regarding a menstruating woman who had performed the tawaf al-ziyarah on the tenth (of Dhu al-Hijjah): Is the tawaf al-wada‘ obligatory for her or not? Zayd (radi Allahu anhu) said:
“It is obligatory for her to perform the tawaf al-wada‘,” while Ibn Abbas (radi Allahu anhu) held that she may return to her homeland without performing the tawaf al-wada‘.
Some people from the Ansar said:
“We are not prepared to accept your statement in opposition to Zayd ibn Thabit (radi Allahu anhu).”
Ibn Abbas (radi Allahu anhu) said:
“Ask Umm Sulaym (radi Allahu anha) about this matter.” So they asked, and Umm Sulaym (radi Allahu anha) informed them:
“She experienced menstruation after performing the tawaf al-ifadah, and the Messenger of Allah (sallallahu alayhi wa sallam) permitted me to return without performing the tawaf al-wada‘.”
Similarly, Safiyyah (radi Allahu anha) experienced menstruation, and he (sallallahu alayhi wa sallam) instructed her to depart.
Other narrations indicate that Zayd ibn Thabit (radi Allahu anhu) retracted his position.
