Hadith 1653

وَسُئِلَ عَطَاءٌ عَنِ الْمُجَاوِرِ يُلَبِّي بِالْحَجِّ ، قَالَ : وَكَانَ ابْنُ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا يُلَبِّي يَوْمَ التَّرْوِيَةِ إِذَا صَلَّى الظُّهْرَ وَاسْتَوَى عَلَى رَاحِلَتِهِ ، وَقَالَ عَبْدُ الْمَلِكِ : عَنْ عَطَاءٍ ، عَنْ جَابِرٍ رَضِيَ اللَّهُ عَنْهُ ، قَدِمْنَا مَعَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَحْلَلْنَا حَتَّى يَوْمِ التَّرْوِيَةِ ، وَجَعَلْنَا مكة بِظَهْرٍ لَبَّيْنَا بِالْحَجِّ , وَقَالَ أَبُو الزُّبَيْرِ : عَنْ جَابِرٍ ، أَهْلَلْنَا مِنْ الْبَطْحَاءِ ، وَقَالَ عُبَيْدُ بْنُ جُرَيْجٍ لِابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا : رَأَيْتُكَ إِذَا كُنْتَ بمكة أَهَلَّ النَّاسُ إِذَا رَأَوْا الْهِلَالَ وَلَمْ تُهِلَّ أَنْتَ حَتَّى يَوْمَ التَّرْوِيَةِ ؟ , فَقَالَ : لَمْ أَرَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يُهِلُّ حَتَّى تَنْبَعِثَ بِهِ رَاحِلَتُهُ .
And likewise, every pilgrim from any country who stays in Mecca after performing ‘Umrah. And ‘Ata bin Abi Rabah was asked about a person who resides in Mecca and intends to say the Talbiyah for Hajj; he said that Ibn ‘Umar (may Allah be pleased with them both), after praying the Zuhr prayer on the eighth of Dhu al-Hijjah, when he was properly seated on his mount, would then say the Talbiyah. ‘Abdul-Malik bin Abi Sulayman narrated from ‘Ata, who narrated from Jabir (may Allah be pleased with him) that we came to Mecca with the Prophet (peace and blessings of Allah be upon him) for the Farewell Hajj, and we became lawful (out of Ihram) until the eighth of Dhu al-Hijjah. And (on that day, when leaving Mecca) as we turned our backs to Mecca, we were reciting the Talbiyah for Hajj. Abu al-Zubair narrated from Jabir (may Allah be pleased with him) that we assumed Ihram from Batha’. And ‘Ubayd bin Jurayj said to Ibn ‘Umar (may Allah be pleased with them both): When you were in Mecca, I saw that all the people assumed Ihram as soon as they saw the new moon, but you did not assume Ihram before the eighth of Dhu al-Hijjah. He replied: I saw the Messenger of Allah (peace and blessings of Allah be upon him); he did not assume Ihram until he was mounted on his camel and ready to go to Mina.
حَدَّثَنِي عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ ، حَدَّثَنَا إِسْحَاقُ الْأَزْرَقُ ، حَدَّثَنَا سُفْيَانُ ، عَنْ عَبْدِ الْعَزِيزِ بْنِ رُفَيْعٍ ، قَالَ : سَأَلْتُ أَنَسَ بْنَ مَالِكٍ رَضِيَ اللَّهُ عَنْهُ ، قُلْتُ : " أَخْبِرْنِي بِشَيْءٍ عَقَلْتَهُ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَيْنَ صَلَّى الظُّهْرَ وَالْعَصْرَ يَوْمَ التَّرْوِيَةِ ؟ قَالَ : بِمِنًى ، قُلْتُ : فَأَيْنَ صَلَّى الْعَصْرَ يَوْمَ النَّفْرِ ؟ قَالَ : بِالْأَبْطَحِ , ثُمَّ قَالَ : افْعَلْ كَمَا يَفْعَلُ أُمَرَاؤُكَ " .
Narrated `Abdul `Aziz bin Rufai: I asked Anas bin Malik, "Tell me what you remember from Allah's Apostle (regarding these questions): Where did he offer the Zuhr and `Asr prayers on the day of Tarwiya (8th day of Dhul- Hijja)?" He relied, "(He offered these prayers) at Mina." I asked, "Where did he offer the `Asr prayer on the day of Nafr (i.e. departure from Mina on the 12th or 13th of Dhul-Hijja)?" He replied, "At Al- Abtah," and then added, "You should do as your chiefs do."

Hadith Commentary:

The Sunnah is that on the eighth of Dhul-Hijjah, the prayers of Dhuhr, Asr, Maghrib, Isha, and the Fajr prayer of the ninth should be performed in Mina.
Doing so is recommended (mustahabb), not obligatory.
It is not correct to use this recommendation as a pretext to oppose the ruler of the time or the congregation.
Following the leaders is necessary, provided it is not against the Shariah.

From the aforementioned narrations, it is understood that, to the extent of permissibility, there is leeway on this day for people to go to Mina whenever they wish and to perform the prayers wherever possible. However, the recommended (mustahabb) practice is that on the eighth, the prayers of Dhuhr, Asr, Maghrib, Isha, and the Fajr prayer of the ninth should be performed in Mina.
