Hadith 1615

حَدَّثَنَا أَصْبَغُ ، عَنِ ابْنِ وَهْبٍ ، أَخْبَرَنِي عَمْرٌو ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ ، ذَكَرْتُ لِعُرْوَةَ ، قال : فَأَخْبَرَتْنِي عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا ، "أَنَّ أَوَّلَ شَيْءٍ بَدَأَ بِهِ حِينَ قَدِمَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّهُ تَوَضَّأَ ، ثُمَّ طَافَ ، ثُمَّ لَمْ تَكُنْ عُمْرَةً ، ثُمَّ حَجَّ أَبُو بَكْرٍ وَعُمَرُ رَضِيَ اللَّهُ عَنْهُمَا مِثْلَهُ ، ثُمَّ حَجَجْتُ مَعَ أَبِي الزُّبَيْرِ رَضِيَ اللَّهُ عَنْهُ ، فَأَوَّلُ شَيْءٍ بَدَأَ بِهِ الطَّوَافُ ، ثُمَّ رَأَيْتُ الْمُهَاجِرِينَ , وَالْأَنْصَارَ يَفْعَلُونَهُ ، وَقَدْ أَخْبَرَتْنِي أُمِّي أَنَّهَا أَهَلَّتْ هِيَ , وَأُخْتُهَا وَالزُّبَيْرُ وَفُلَانٌ وَفُلَانٌ بِعُمْرَةٍ ، فَلَمَّا مَسَحُوا الرُّكْنَ حَلُّوا .
Narrated `Urwa: `Aisha said, "The first thing the Prophet did on reaching Mecca, was the ablution and then he performed Tawaf of the Ka`ba and that was not `Umra (alone), (but Hajj-al-Qiran). `Urwa added: Later Abu Bakr and `Umar did the same in their Hajj." And I performed the Hajj with my father Az- Zubair, and the first thing he did was Tawaf of the Ka`ba. Later I saw the Muhajirin (Emigrants) and the Ansar doing the same. My mother (Asma') told me that she, her sister (`Aisha), Az-Zubair and such and such persons assumed Ihram for `Umra, and after they passed their hands over the Black Stone Corner (of the Ka`ba) they finished the Ihram. (i.e. After doing Tawaf of the Ka`ba and Sa`i between Safa-Marwa.

Hadith Commentary:
Imam Bukhari rahimahullah means that in ‘umrah, merely performing the tawaf (circumambulation) does not complete a person’s ‘umrah until he also performs sa‘i (walking) between Safa and Marwah.
Although something contrary to this has been narrated from Ibn ‘Abbas radi Allahu anhu,
this view is against the majority of scholars, and Imam Bukhari rahimahullah has also refuted it.
Some say that the school of Ibn ‘Abbas radi Allahu anhu is that whoever intends to perform Hajj Mufrad (single Hajj), when he enters the House of Allah, he should not perform tawaf until he returns from ‘Arafat.
If he does perform tawaf, he will become halal (released from the state of ihram),
and the ihram of Hajj will be invalidated.
This view (and that he should run between Safa and Marwah and shave his head)
is also against the majority of scholars, and Imam Bukhari rahimahullah has brought this chapter to refute this view (Wahidi).

The position of Ibn Abbas (radi Allahu anhu) is that when performing ‘umrah, after making the circumambulation (tawaf) of the Ka‘bah, the pilgrim in the state of ihram becomes lawful (halal), and there is no need for the sa‘y (walking) between Safa and Marwah.
Imam Bukhari (rahimahullah) has established that whoever comes to Makkah with the intention of Hajj or ‘umrah should first perform the circumambulation (tawaf) of the Ka‘bah, then offer two units (rak‘ah) of voluntary prayer, and after that perform the sa‘y between Safa and Marwah, and then shave (halq) the head.
If he has donned the ihram for ‘umrah, then he should exit the state of ihram; and if he has donned the ihram for Hajj, then he should not exit the state of ihram until he goes to Mina on the eighth of Dhu’l-Hijjah and performs the rites of Hajj.

‘Urwah (rahimahullah) narrated this hadith in response to a question posed by a man, as reported by Imam Muslim (rahimahullah).
Muhammad ibn ‘Abd al-Rahman says:
An Iraqi said to me: Ask ‘Urwah ibn al-Zubayr (rahimahullah) whether a man who dons the ihram only for Hajj, when he performs the circumambulation (tawaf) of the Ka‘bah, is it permissible for him to exit the state of ihram? If he tells you that it is not permissible for him to exit the state of ihram, then say to him: There is a man who gives a fatwa to that effect. So, when he asked ‘Urwah (rahimahullah) about this, he replied:
It is not permissible for him to exit the state of ihram; rather, he will only exit ihram after completing Hajj.
When I conveyed ‘Urwah’s answer to that man, he said:
There is a man who narrates that the Messenger of Allah (sallallahu alayhi wa sallam) did this.
Asma’ and Zubayr (radi Allahu anhuma) also did the same.
That man then went to ‘Urwah (rahimahullah) again and informed him of what the other person had said, so he (‘Urwah) asked: Who is the questioner? Why does he not come before me himself? I think he is an Iraqi, because these people mention such issues.
‘A’ishah (radi Allahu anha), while describing the Hajj of the Messenger of Allah (sallallahu alayhi wa sallam), states that when the Messenger of Allah (sallallahu alayhi wa sallam) came to Makkah, he first performed ablution (wudu) and then performed the circumambulation (tawaf) of the Ka‘bah.

In summary, Imam Bukhari (rahimahullah) wishes to clarify that ‘umrah is not completed merely by performing the circumambulation (tawaf) of the Ka‘bah until the sa‘y between Safa and Marwah is also performed.
