Hadith 1611

حَدَّثَنَا مُسَدَّدٌ ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ الزُّبَيْرِ بْنِ عَرَبِيٍّ ، قال : " سَأَلَ رَجُلٌ ابْنَ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا عَنِ اسْتِلَامِ الْحَجَرِ ، فَقَالَ : رَأَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَسْتَلِمُهُ وَيُقَبِّلُهُ ، قَالَ : قُلْتُ : أَرَأَيْتَ إِنْ زُحِمْتُ ، أَرَأَيْتَ إِنْ غُلِبْتُ ، قَالَ : اجْعَلْ أَرَأَيْتَ بِالْيَمَنِ رَأَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَسْتَلِمُهُ وَيُقَبِّلُهُ " .
Narrated Az-Zubair bin 'Arabi: A man asked Ibn `Umar about the touching of the Black Stone. Ibn `Umar said, "I saw Allah's Apostle touching and kissing it." The questioner said, "But if there were a throng (much rush) round the Ka`ba and the people overpowered me, (what would I do?)" He replied angrily, "Stay in Yemen (as that man was from Yemen). I saw Allah's Apostle touching and kissing it."

Hadith Commentary:

The person who questioned Ibn Umar radi Allahu anhu was a Yemeni, so he said: If you are a seeker of the Sunnah and have traveled such a long distance for this very reason, then abandon your own opinion and act upon the Sunnah.
From Ibn Umar’s radi Allahu anhu zeal for following the Sunnah, it is evident that in comparison to the words and actions of the Messenger of Allah sallallahu alayhi wa sallam, tricks and excuses hold no value; rather, a sign of faith is that upon hearing a hadith, one immediately begins to act upon it.
Ibn Umar radi Allahu anhu thought that the questioner was opposing the hadith through “ifs” and “buts,” so he repeated his eyewitness account regarding the Messenger of Allah sallallahu alayhi wa sallam.

From this, it is understood that crowding is not a valid excuse for abandoning istilam (touching or kissing the Black Stone), as Ibn Umar radi Allahu anhu would persist in performing istilam of the corner even to the extent of being injured. However, Ibn Abbas radi Allahu anhu considered such pushing and shoving to be disliked (makruh) and used to say: Do not harm anyone while performing istilam, nor be a cause of pain for another.

It should be noted that when kissing the Black Stone (Hajar al-Aswad), one should not make a sound. Thus, Sa’id ibn Jubayr said: When you kiss the Black Stone, do not raise your voice.

It is narrated from Ibn Abbas radi Allahu anhu that the Messenger of Allah sallallahu alayhi wa sallam said:
“On the Day of Resurrection, this stone will come having two eyes with which it will see and a tongue with which it will speak, and it will bear witness for the one who kissed it with truth.”
