باب حد الزاني البكر والثيبPunishment for fornicator, married and unmarried
Hadith 811
حَدَّثَنَا ابْنُ الْمُقْرِئِ ، قَالَ : ثنا سُفْيَانُ ، عَنِ الزُّهْرِيِّ ، عَنْ عُبَيْدِ اللَّهِ ، عَنْ أَبِي هُرَيْرَةَ ، وَزَيْدِ بْنِ خَالِدٍ ، وَشِبْلٍ ، قَالُوا : كُنَّا عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَجَاءَ رَجُلٌ ، فَقَالَ : أَنْشُدُكَ بِاللَّهِ إِلا قَضَيْتَ بَيْنَنَا بِكِتَابِ اللَّهِ ، فَقَامَ خَصْمُهُ وَكَانَ أَفْقَهَ مِنْهُ ، فَقَالَ : صَدَقَ اقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ وَائْذَنْ لِي ، قَالَ : قُلْ ، قَالَ : إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا ، وَإِنَّهُ زَنَى بِامْرَأَتِهِ ، فَأُخْبِرْتُ أَنَّ عَلَى ابْنِي الرَّجْمَ ، فَافْتَدَيْتُ مِنْهُ مِائَةَ شَاةٍ وَخَادِمٍ ، فَسَأَلْتُ رِجَالا مِنْ أَهْلِ الْعِلْمِ ، فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ ، وَأَنَّ عَلَى امْرَأَةِ هَذَا الرَّجْمَ ، فَقَالَ : لأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ ، " الْمِائَةُ شَاةٍ وَالْخَادِمُ رَدٌّ ، وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ ، وَاغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا ، فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا " ، فَاعْتَرَفَتْ فَرَجَمَهَا .
Sayyiduna Abu Hurairah, Sayyiduna Zaid bin Khalid, and Sayyiduna Shibl (may Allah be pleased with them) narrate that we were with the Prophet Muhammad (peace and blessings be upon him) when a man came and said: I beseech you by Allah to judge between us according to the Book of Allah. His opponent, who was more intelligent, also stood up and said: Yes, judge between us according to the Book of Allah and allow me to speak. The Prophet (peace and blessings be upon him) said: Speak. He said: My son was working for them, and he committed adultery with their wife. I was informed that my son’s punishment is stoning, so I gave one hundred sheep and a slave as compensation. After that, I asked the scholars, and they told me that my son’s punishment is one hundred lashes and one year of exile, and the woman’s punishment is stoning. The Prophet (peace and blessings be upon him) said: I will judge between you according to the Book of Allah. The one hundred sheep and the slave will be returned, and your son’s punishment is one hundred lashes and one year of exile. Anis! Go to this man’s wife, and if she confesses, then stone her.
