Hadith 859

859 صحيح حديث ابْنِ عَبَّاسٍ، قَالَ: قَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ ، يَوْمَ افْتَتَحَ مَكَّةَ: لاَ هِجْرَةَ [ص:78] وَلكِنْ جِهَادٌ وَنِيَّةٌ، وَإِذَا اسْتُنْفِرْتُمْ فَانْفِرُوا، فَإِنَّ هذَا بَلَدٌ حَرَّمَ اللهُ يَوْمَ خَلَقَ السَّموَاتِ وَالأَرْضَ، وَهُوَ حَرَامٌ بِحُرْمَةِ اللهِ إِلَى يَوْمِ الْقِيَامَةِ، وَإِنَّهُ لَمْ يَحِلَّ الْقِتَالُ فِيهِ َلأحَدٍ قَبْلِى، وَلَمْ يَحِلَّ لِي إِلاَّ سَاعَةً مِنْ نَهَارٍ، فَهُوَ حَرَامٌ بِحُرْمَةِ اللهِ إِلَى يَوْمِ الْقِيَامَةِ، لاَ يُعْضَدُ شَوْكُهُ، وَلاَ يُنَفَّرُ صَيْدُهُ، وَلاَ يَلْتَقِطُ لُقَطَتَهُ إِلاَّ مَنْ عَرَّفَهَا، وَلاَ يُخْتَلَى خَلاَهَا قَالَ الْعَبَّاسُ: يَا رَسُولَ اللهِ إِلاَّ الإِذْخِرَ فَإِنَّهُ لِقَيْنِهِمْ وَلِبُيُوتِهِمْ قَالَ: قَالَ: إِلاَّ الإِذْخِرَ
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrated that the Messenger of Allah (peace and blessings be upon him) said on the day of the conquest of Makkah: "Now migration is no longer obligatory, but (good) intention and jihad still remain. Therefore, when you are called for jihad, be ready. Allah Almighty granted sanctity to this city (Makkah) on the very day He created the heavens and the earth, so it is sacred due to the sanctity decreed by Allah. It was not permissible for anyone before me to fight here, and it was permitted for me only for a short time on one day (the day of the conquest of Makkah). Now, due to the sanctity established by Allah, this city will remain sacred until the Day of Resurrection. Therefore, neither its thorn should be cut, nor its game chased, and except for the one who intends to announce it, no one should pick up anything dropped here, nor should its grass be uprooted." Sayyiduna Abbas (may Allah be pleased with him) said, "O Messenger of Allah, please allow (the use of) idhkhir (a type of grass), for it is necessary here for craftsmen and households." So he (peace and blessings be upon him) said, "Idhkhir is permitted."

Brief Explanation
Since after the conquest of Makkah, Makkah has become a land of Islam (dar al-salam), therefore the obligation of migration (hijrah) from here to Madinah has ended. However, striving in jihad against the disbelievers and having good intentions in virtuous deeds still remain, through which we can attain those virtues that were attained through migration. Imam Mawardi, quoting the statement of Imam Nawawi, says that among the special characteristics of the Haram is that fighting and combat with those residing in the Haram is prohibited. Even if they rebel against the people of justice, the jurists (fuqaha) have given the fatwa of the prohibition of fighting them and have said that they should be compelled to return to obedience and to refer back to the laws of the people of justice. The majority of scholars (jumhur ulama) have said that when it is not possible to make them return from rebellion without fighting, then it is permissible to fight them, because fighting rebels is among the rights of Allah (huquq Allah), and the neglect of the rights of Allah is not permissible. Imam Nawawi has also given preference to this latter opinion. (Murattib rahimahullah)
