Hadith 5321

عَنْهُ مِنْ طَرِيقٍ ثَانٍ بِنَحْوِهِ وَزَادَ قَالَ فَخَرَجَ الْأَشْعَثُ وَهُوَ يَقْرَؤُهَا قَالَ فِيَّ أُنْزِلَتْ هَذِهِ الْآيَةُ إِنَّ رَجُلًا ادَّعَى رَكِيًّا لِي فَاخْتَصَمْنَا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ شَاهِدَاكَ أَوْ يَمِينُهُ فَقُلْتُ أَمَا إِنَّهُ إِنْ حَلَفَ حَلَفَ فَاجِرًا فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مَنْ حَلَفَ عَلَى يَمِينٍ صَبْرًا يَسْتَحِقُّ بِهَا مَالًا لَقِيَ اللَّهَ وَهُوَ عَلَيْهِ غَضْبَانُ
. (Second chain) There is a similar narration, except these words are additional: Sayyiduna Ash’ath (may Allah be pleased with him) came out reciting this verse and said: This verse was revealed about me, and it happened that a man claimed my well. So we brought the dispute to the Messenger of Allah (peace and blessings be upon him). He (peace and blessings be upon him) said to him: Your two witnesses, or his oath? I said: If he takes an oath, he will take a false oath. Then the Noble Prophet (peace and blessings be upon him) said: Whoever takes an oath before a ruler to wrongfully claim someone’s wealth, will meet Allah while He is angry with him.

Brief Explanation
Benefits: … Yamin al-Sabr: This refers to that false oath which a person deliberately takes with the intention of unlawfully seizing the wealth of a Muslim. The reason for its naming is that the person binds himself to this oath, or he is restrained before a ruler or judge, because the original meaning of "sabr" is to restrain.
