Hadith 3384

It is narrated from Sayyiduna Muawiyah bin Haydah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: For every forty grazing camels, one bint labun (a two-year-old she-camel) is due as zakat. The camels (shared to avoid zakat) will not be separated. Whoever gives zakat with the intention of reward will receive its reward, and whoever does not pay it, then we will ourselves take it (by force) from him, and (as a penalty) we will also take some of his camels from among his camels, because this is among the obligatory rights of Allah Almighty, and it is not lawful for the family of Muhammad (peace and blessings be upon him) to take anything from it.

Brief Explanation
Benefits: If zakat is taken from someone by force, it will suffice for him. From this hadith, it is understood that the caliph has the right to impose a penalty on the subjects for any crime they commit. According to the narrations of Sunan Abi Dawud, there are two more examples of this: (1) Taking one extra camel from the person who hides a lost camel, and (2) If a person takes fruit from a tree along with himself, he will be fined double the amount of that fruit.
