Hadith 3799

حَدَّثَنَا إِبْرَاهِيمُ بْنُ خَالِدٍ الْكَلْبِيُّ أَبُو ثَوْرٍ ، حَدَّثَنَا سَعِيدُ بْنُ مَنْصُورٍ ، حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ ، عَنْ عِيسَى بْنِ نُمَيْلَةَ ، عَنْ أَبِيهِ ، قَالَ : " كُنْتُ عِنْدَ ابْنِ عُمَرَ ، فَسُئِلَ عَنْ أَكْلِ الْقُنْفُذِ ؟ ، فَتَلَا : قُلْ لا أَجِدُ فِي مَا أُوحِيَ إِلَيَّ مُحَرَّمًا سورة الأنعام آية 145 ، قَالَ : قَالَ شَيْخٌ عِنْدَهُ : سَمِعْتُ أَبَا هُرَيْرَةَ ، يَقُولُ : ذُكِرَ عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : خَبِيثَةٌ مِنَ الْخَبَائِثِ ، فَقَالَ ابْنُ عُمَرَ : إِنْ كَانَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ هَذَا ، فَهُوَ كَمَا قَالَ مَا لَمْ نَدْرِ " .
Narrated Abdullah ibn Umar: Numaylah said: I was with Ibn Umar. He was asked about eating hedgehog. He recited: "Say: I find not in the message received by me by inspiration any (meat) forbidden. " An old man who was with him said: I heard Abu Hurairah say: It was mentioned to the Messenger of Allah ﷺ. Noxious of the noxious. Ibn Umar said: If the Messenger of Allah ﷺ had said it, it is as he said that we did not know.

Explanation & Benefits
Shaykh Umar Farooq Saeedi
Benefits and Issues:
Benefit: There is a difference of opinion among the scholars regarding the permissibility or prohibition of the hedgehog.
Some have declared it permissible (halal) and some have declared it prohibited (haram).
However, Shaykh Ibn Baz, regarding this matter, states:
The more correct opinion is that it is halal,
because the basic principle regarding animals is permissibility (halal),
and only those are haram among them which have been declared haram by the Shari‘ah.
And regarding this animal, there is no such evidence in the Shari‘ah which indicates that this animal is haram.
It eats plants like the rabbit and the deer, and it is also not among the predatory animals that hunt with fangs.
Therefore, there is no reason for it to be haram.
This is one of the types of the aforementioned sahiyyah animals.
It is also referred to by the name “daldal.”
Whereas the aforementioned narration, according to the verifying scholars, is weak in its chain of transmission.

«أخرجه أبوداود، الأطعمة، باب في أكل حشرات الأرض، حديث:3799، وأحمد:2 /381، عيسي بن نميلة وأبوه مجهولان، والشيخ مجهول، والحديث ضعفه الخطابي وغيره.»©Explanation:
➊ This hadith establishes the prohibition of the hedgehog, that is, the porcupine. This is the opinion of Imam Abu Hanifah and Imam Ahmad rahimahum Allah. However, this hadith is weak, as explicitly stated by Hafiz Ibn Hajar rahimahullah and other researchers.

➋ Imam Malik and Ibn Abi Ya’la rahimahum Allah are of the view that it is lawful (halal), because there is no authentic evidence for its prohibition (see: Subul al-Salam). Likewise, Shaykh Ibn Baz rahimahullah writes regarding this that the more correct opinion is that it is lawful, because the basic principle regarding animals is permissibility, and only those are unlawful (haram) which the Shari‘ah has declared unlawful. There is no such evidence in the Shari‘ah indicating that this animal is unlawful.

He further writes that it eats plants like the rabbit and the deer, and it is not among the predatory animals that hunt with fangs; therefore, there appears to be no reason for it to be unlawful. This mentioned animal is one of the types of porcupine; it is also known by the name “dalal,” whereas the aforementioned narration is, according to the scholars of research, weak in its chain of transmission.
