Question
If no one in a village is literate, will a nikāḥ conducted without a sermon (khuṭbah) still be valid or not?
✔ Answer
Alḥamdulillāh, waṣ-ṣalātu was-salāmu ʿalā Rasūlillāh, Ammā Baʿd!
The answer to this question is essentially the same as the previous one. The validity of nikāḥ depends on its Sharʿī conditions, not on the recitation of the sermon.
◈ Conditions of a Valid Nikāḥ
➊ The woman must not be from among the prohibited degrees (maḥārim).
➋ There must be ījāb and qubūl (clear expression of offer and acceptance).
➌ Two witnesses must be present.
➍ The guardian (walī al-nikāḥ) must consent.
➎ The mahr (dowry) must be specified.
◈ Status of the Sermon
- The khutbah is a Sunnah supplication.
- It is not a condition for the validity of the nikāḥ.
- Therefore, if the above conditions are fulfilled, the nikāḥ is valid even without a sermon.
Hadhā mā ʿindī, wallāhu aʿlam bis-ṣawāb.
