Question:
Is it permissible for a man to marry in exchange for the dowry (mahr) of his daughter or sister?
Answer:
The dowry of a daughter or sister is solely her right. However, if she willingly and by her own choice gifts all or part of her mahr to him, and if this action is valid in Sharīʿah, she may do so. If she does not gift it to him, then he is not permitted to take anything from it.
A father may only take a portion of his daughter’s mahr if it does not harm her and he does not treat others unfairly by favoring one over another. As the Prophet ﷺ said:
“The purest of what you eat is what you earn, and your children are from what you earn.”
(Narrated by al-Tirmidhī in al-Aḥkām bāb 22; al-Nasāʾī in Kitāb al-Buyūʿ bāb 1; Aḥmad 6/162; Ibn Mājah in Kitāb al-Tijārāt bāb 64)
